Employment-Based Green Card April 2023 Bulletin

It’s no secret that for those looking to become permanent residents in the U.S., the wait for their priority date to be current can sometimes feel like an eternity.

But this April, there’s a glimmer of hope for Employment-based Green Card holders.USCIS will be returning to using the Visa Bulletin Final Action Dates chart instead of the more lenient Dates for Filing chart that it had been using.

Despite predictions of retrogression in the EB-2 category for all countries except China, USCIS has decided to return to the Final Action Dates chart for the Employment-based category. This means that green cards are now available to those with priority dates as of April 2023.
This month, there will be some changes to the Final Action dates for EB-1 India and China, EB-2 Worldwide, and EB-3 India Professional/Skilled Workers.

While this may seem like a small change, it could mean the difference between waiting months or years to receive their Green Card.

According to the April 2023 Visa Bulletin, employment dates for filing will be as follows:

EB-1: All the countries except China and India will remain current. For China and India, the dates for filing are June 1, 2022.

EB-2: For China, the date for filing is July 8, 2019. India’s date for filing is set to May 1, 2012, and all other countries will remain current.

EB-3 Professionals and Skilled Workers: For China, the date for filing is February 1, 2019. India’s date for filing is set to August 1, 2012, and all other countries will remain current.

EB-3 Other Workers: For China, the date for filing is November 1, 2015. India’s date for filing is set to August 1, 2012, and all other countries will remain current.

According to the April Visa Bulletin, final action dates will be as follows:

EB-1:  China and India will remain on February 1, 2022. For all other countries, the date is current.

EB-2: China’s date will remain at June 8, 2019; India’s date is set to January 1, 2011, and all other countries’ dates are July 1, 2022.

EB-3 Professionals and Skilled Workers: China’s final action date is November 1, 2018, India’s final action date is set to June 15, 2012, and all other countries remain current.

EB-3 Other Workers: China’s date for filing is October 1, 2014, India’s date for filing is set to June 15, 2012, and all other countries remain current.

April 2023’s bulletin brings with it some hope for those seeking an employment-based Green Card.
